1. Agreement to these terms

These Terms & Conditions ("Terms") are an agreement between you and Anastasiia Vysotska ("we", "us") covering your use of the Stepper app. By downloading or using Stepper, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the app.

2. What Stepper does

Stepper lets you plan walking routes on a map, see estimated steps, distance, time and calories, track walks with your iPhone's location and motion sensors, and save routes and walks with photos. Features may change as we improve the app.

3. Eligibility

You must be old enough to agree to these Terms where you live. If you're under that age, use Stepper only with the involvement of a parent or guardian who agrees to these Terms for you.

4. License to use the app

We grant you a personal, non-exclusive, non-transferable, revocable license to use Stepper on Apple devices you own or control, as permitted by the Apple Media Services Terms and Conditions. All rights not expressly granted are reserved by us.

5. Walk safely

Your safety comes first. Always pay attention to your surroundings, follow traffic laws and local rules, and don't look at your phone while crossing streets or in other risky situations.

Routes are generated from third-party map data and may include paths that are closed, private, under construction, poorly lit or otherwise unsuitable. Use your own judgment about where and when it's safe to walk. You are responsible for your own safety while using Stepper.

6. Estimates, not medical advice

Steps, distance, time and calories shown in Stepper are estimates based on average values, such as a 0.762 m stride and a 5 km/h pace, and on your device's sensors. They may not be accurate for you. Stepper isn't a medical device and doesn't provide medical advice. Talk to a healthcare professional before starting a new exercise routine.

7. Your content

Routes, walk names and photos you create or add remain yours. They're stored on your device and in your iCloud; we don't claim any ownership of them. You're responsible for the content you add and for having the right to use it.

8. Acceptable use

You agree not to:

  • copy, modify, reverse engineer or decompile the app, except where the law allows it;
  • use Stepper in a way that breaks the law or infringes anyone's rights;
  • interfere with the app, the services it relies on, or other people's use of them;
  • misuse the map and directions data outside the app.

9. Third-party services

Stepper uses Google Maps Platform for maps and directions. By using Stepper, you also agree to the Google Maps/Google Earth Additional Terms of Service and acknowledge the Google Privacy Policy. iCloud sync is provided by Apple under Apple's terms. We aren't responsible for third-party services.

10. Intellectual property

The Stepper app, name, logo, design and content (excluding your content and third-party map data) belong to us and are protected by intellectual property laws.

11. Disclaimers

Stepper is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We don't guarantee that the app, routes or estimates will be accurate, uninterrupted or error-free.

12. Limitation of liability

To the fullest extent permitted by law, we won't be liable for any indirect, incidental, special or consequential damages, or for any injury, loss or damage arising from walking a route or using the app. Our total liability for any claim relating to Stepper is limited to the amount you paid for the app, if any. Some places don't allow these limits, so they may not apply to you.

13. Changes and termination

We may update the app or these Terms from time to time. If we make significant changes to the Terms, we'll update the date above and let you know in the app. You can stop using Stepper at any time by deleting it. We may suspend your license if you seriously breach these Terms.

14. Apple App Store terms

  • These Terms are between you and us, not Apple. Apple is not responsible for Stepper or its content.
  • Apple has no obligation to provide maintenance or support for the app.
  • If Stepper fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. Apple has no other warranty obligation for the app.
  • Apple is not responsible for any claims relating to the app, including product liability, legal or regulatory compliance, consumer protection or intellectual property claims.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

15. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Nothing in these Terms limits rights you have under the consumer protection laws of the country where you live.
